PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE PLATFORM.
1. Agreement to Terms
By accessing, browsing, or using ESPBoards Learn ("the Platform," "Service," "we," "us," or "our"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and ESPBoards Learn. If you do not agree to these Terms in their entirety, you are not authorized to access or use the Platform.
We reserve the right to modify, update, or discontinue any aspect of the Platform at any time without prior notice. Your continued use of the Platform following any changes constitutes your acceptance of such changes.
2. Description of Service
ESPBoards Learn is an online educational platform that may provide:
- Interactive lessons on ESP32 and embedded systems programming
- Hands-on projects and tutorials
- Progress tracking and gamification features
- Community discussion forums
- Web-based tools for firmware flashing and serial monitoring
We reserve the right to modify, suspend, or discontinue any feature, content, or service at our sole discretion without liability. The availability and functionality of features may vary by region, device, or subscription tier. We do not guarantee that any specific content or feature will remain available.
3. Account Registration & Security
To access certain features, you must create an account. By creating an account, you represent, warrant, and agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Maintain the confidentiality and security of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept full responsibility for all activities that occur under your account
- Not share, transfer, or sell your account to any third party
You must be at least 18 years old to create an account and use this Platform. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or market to individuals under 18 years of age. If we learn that we have collected personal information from a user under 18, we will delete that information promptly. We are not liable for any unauthorized account access resulting from your failure to maintain account security.
We reserve the right to suspend, disable, or delete your account at our sole discretion, with or without notice, for any reason including but not limited to: violation of these Terms, fraudulent activity, extended periods of inactivity, or upon your request.
4. Subscriptions, Payments & Billing
Free & Paid Content
Some content on the Platform may be available for free. Premium content requires a paid subscription or one-time purchase. We reserve the right to change what content is free or paid at any time without notice.
Payment Processing
Payments are processed through third-party payment processors such as Stripe. By making a purchase, you agree to the terms of service of our payment processors. You represent and warrant that you have the legal right to use any payment method provided. All prices are displayed in USD unless otherwise stated. Prices are subject to change without notice. We are not responsible for any fees charged by your bank or payment provider.
Subscription Billing & Auto-Renewal
BY PURCHASING A SUBSCRIPTION, YOU AUTHORIZE US TO AUTOMATICALLY CHARGE YOUR PAYMENT METHOD ON A RECURRING BASIS AT THE THEN-CURRENT RATE UNTIL YOU CANCEL. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no prorated refunds will be issued for partial periods.
Refunds
We may offer a 14-day refund for first-time subscribers at our sole discretion. Refund requests must be submitted within 14 days of the initial purchase. Refunds are NOT available for: renewal payments, accounts that have accessed more than 25% of paid content, accounts showing signs of abuse, or users who have previously received a refund. We reserve the right to deny refund requests and to modify or discontinue the refund policy at any time.
Price Changes
We reserve the right to change subscription prices at any time. Price changes for existing subscribers will take effect at the next renewal period following notice. Your continued subscription after a price change constitutes acceptance of the new price.
5. User-Generated Content
You may post content in our community forums and discussions ("User Content"). By posting User Content, you:
- Grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in any media format and through any channels
- Represent and warrant that you own or have all necessary rights to your User Content
- Represent that your User Content does not infringe any third-party rights
- Agree that you are solely responsible for your User Content and its consequences
- Waive any moral rights in your User Content to the extent permitted by law
We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion for any reason, including but not limited to: content that violates these Terms, is objectionable, or could harm the Platform's reputation. We are not responsible for any User Content posted by users.
You agree to indemnify us against any claims arising from your User Content.
6. Prohibited Conduct
You agree not to, and shall not permit any third party to:
- Share, transfer, sell, or sublicense your account credentials or access
- Copy, reproduce, redistribute, publish, or resell any Platform content
- Use automated tools, bots, scrapers, or crawlers to access or download content
- Reverse engineer, decompile, or disassemble any part of the Platform
- Circumvent, disable, or interfere with security features or access restrictions
- Harass, threaten, abuse, defame, or harm other users or our personnel
- Post spam, malware, phishing attempts, or malicious content
- Impersonate any person or entity, or misrepresent your affiliation
- Use the Platform for any illegal, fraudulent, or unauthorized purpose
- Interfere with or disrupt the Platform's operation or infrastructure
- Collect personal information of other users without consent
- Use the Platform to compete with us or develop competing products
- Record, screenshot, or capture lessons or paid content for redistribution
- Create multiple accounts to abuse free trials, promotions, or circumvent bans
Violation of these prohibitions may result in immediate account termination, legal action, and/or notification to law enforcement authorities.
7. Intellectual Property Rights
All content on the Platform, including but not limited to: lessons, tutorials, videos, code examples, graphics, logos, icons, images, audio, text, software, user interface design, and overall look and feel ("Platform Content") is the exclusive property of ESPBoards Learn or our licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for your personal, non-commercial educational purposes, subject to these Terms. This license does not include the right to:
- Reproduce, distribute, or publicly display Platform Content
- Modify, create derivative works, or translate Platform Content
- Use Platform Content for commercial purposes without written permission
- Remove any copyright, trademark, or proprietary notices
Code Examples: Code snippets provided in lessons may be used in your personal and commercial projects, provided such use does not constitute redistribution of the educational content itself. This license is provided "as-is" without any warranty.
All trademarks, service marks, and trade names are the property of their respective owners.
8. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES REGARDING ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF CONTENT

Voltage & Power Warnings: ESP32 GPIO pins operate at 3.3V. Applying voltages higher than 3.3V (such as 5V) to GPIO pins may permanently damage your ESP32 board. Always verify voltage levels before connecting components. Use appropriate level shifters when interfacing with 5V devices. Never use unknown or uncertified power supplies. We are not responsible for damage caused by improper power connections.
Board Variants & Pinouts: ESP32 boards are manufactured by various companies and come in many variants (ESP32, ESP32-S2, ESP32-S3, ESP32-C3, etc.). Pinouts, specifications, and capabilities vary significantly between variants and manufacturers. Diagrams and examples provided in our lessons are representative only. You are responsible for verifying your specific board's pinout and specifications before making any connections. Always consult your board manufacturer's documentation.
Not for Production or Safety-Critical Use: All code examples, projects, and techniques provided on this Platform are intended solely for learning and prototyping purposes. Our content is NOT intended for use in: medical devices or healthcare systems, automotive or transportation systems, industrial control or manufacturing systems, life-safety or emergency systems, any application where failure could result in injury, death, or significant property damage. You assume full responsibility for any use of our content beyond personal learning and experimentation.
Third-Party Services: We are not responsible for the availability, accuracy, or reliability of any third-party services, websites, or tools referenced or integrated with the Platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ESPBOARDS LEARN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, goodwill, or other intangible losses
- Cost of procurement of substitute goods or services
- Unauthorized access to or alteration of your data
- Damages resulting from hardware failure, personal injury, or property damage
- Any matter beyond our reasonable control
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to defend, indemnify, and hold harmless ESPBoards Learn, its affiliates, officers, directors, employees, agents, partners, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable law or regulation
- Any activity conducted through your account
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
11. Termination
We may suspend, restrict, or terminate your access to the Platform and/or your account at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to:
- Violation of these Terms or any applicable policies
- Request by law enforcement or government agencies
- Discontinuation of the Platform or any part thereof
- Unexpected technical or security issues
- Extended periods of inactivity
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
Upon termination: (a) your right to access the Platform and paid content ends immediately; (b) you remain liable for all obligations incurred prior to termination; (c) we may delete your account and data without liability; (d) provisions that by their nature should survive (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive termination.
You may delete your account at any time through your account settings. Account deletion does not entitle you to any refund of subscription fees.
12. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution: Before filing any formal dispute, you agree to first contact us at info@espboards.dev to attempt informal resolution. Most disputes can be resolved quickly and amicably.
Binding Arbitration: If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Class Action Waiver: YOU AND ESPBOARDS LEARN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Limitation Period: Any claim arising out of or relating to these Terms or the Platform must be filed within one (1) year after the claim arose, or the claim is permanently barred.
13. Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the Platform. We may, but are not obligated to, notify you of material changes via email or through the Platform.
Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform immediately. It is your responsibility to review these Terms periodically.
14. Governing Law & Jurisdiction
These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the jurisdiction in which ESPBoards Learn operates, without regard to its conflict of law provisions.
To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the courts located in our principal place of business for the resolution of any disputes.
15. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ESPBoards Learn regarding the Platform and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms without restriction.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
16. Third-Party Licenses & Attributions
This Platform uses and teaches concepts based on third-party open-source frameworks, libraries, and components. Code examples in our lessons may be based on or derived from these frameworks. Your use of such components is subject to their respective licenses. We make no representations or warranties regarding third-party components. All third-party code is provided "as-is" without warranty.

Our Platform uses the Web Serial API, a browser standard that allows web applications to communicate with serial devices. This API requires user permission and a compatible browser (Chrome, Edge, Opera). Web Serial is not available in all browsers. We are not responsible for browser compatibility issues or data transmitted via serial connection.
